Contests & Sweepstakes – Rules

Let’s be honest. Putting in the effort it takes to improve your financial literacy isn’t always fun, but it’s necessary if you want to be successful. With that in mind, Consolidated Credit Counseling Services of Canada, Inc. (the “Sponsor”) periodically holds various contests and sweepstakes that try to make getting out of debt and building a better financial world a little more fun. We’re happy to offer people a little incentive to improve their financial savvy, so they can be successful.

This page provides information about our current open contests, as well as general rules for entry. Simply follow the instructions and you may be rewarded for doing right by your finances!

General Contest Rules

By entering the Client Story Contest (the “Contest”), the Eligible Participant (as defined below) agrees to abide by these contest rules (these “Contest Rules”) and the decisions of the Sponsor with respect to all aspects of the Contest, which are final and legally binding on the entrants.

1.         CONTEST PERIOD: The Contest will run every other month as the Sponsor discretion.  Each Contest period will begin on the first of the designated month at 12:00:01 AM Eastern Standard Time (“EST”)  and ends at 11:59:59 PM EST on the last day of the designated month (the “Contest Period”). All entries must be submitted by 11:59:59 PM EST on the last day of the designated month (the “Contest Closing Time”). Entries submitted after the Contest Closing Time will not be accepted.

2.         HOW TO ENTER: NO PURCHASE NECESSARY. Entries must be received during the Contest Period. To enter the Contest, entrants must submit a written entry to [email protected] of no fewer than 500 words describing how Consolidated Credit assisted them in overcoming debt-related challenges and achieving improved financial well-being. Eligible entries will be reviewed, and selected entrants may be contacted to participate in a recorded video interview. All individuals whose stories are selected for a video interview will be entered into a drawing for a $250 prize. All entries are subject to verification by the Sponsor at any time. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility from any Entrant, which proof shall be in the form required by the Sponsor. Failure to provide proof of identity and/or eligibility to the satisfaction of the Sponsor in a timely manner may result in disqualification from the Contest.

3.         ENTRY ELIGIBILITY: To enter and be eligible to win the Prize (as defined below), a person must: (i) be a legal resident of Canada, excluding the Province of Quebec, (ii) have reached the age of majority in their Province or Territory of residence, (iii) be an existing client of the Sponsor at the time of entry, and (iv) not be an employee of the Sponsor, its subsidiaries, affiliates, related companies or agencies, or a member of their immediate families or any person with whom they are domiciled (each an “Eligible Participant” or “Entrant”). To participate in the Contest, an Eligible Participant must meet the eligibility requirements set out in these Contest Rules from the time of entry until the time the Eligible Participant is confirmed the winner.

4.        PRIZES: The Prize(s) (the “Prize”) areavailable to be won by Eligible Participants from among all eligible entries received by the last day of the Contest Period(s). The Prize consists of $250 gift card. The odds of being drawn as a potential prize winner depend on the total number of eligible entries received during the Contest Period. All amounts and costs related to the Prize, including but not limited to all income, sales, use and other taxes (and the reporting thereof) imposed as a result of the award of the Prize, which are not expressly stated as covered by the Sponsor in these Contest Rules are the responsibility of the individual winner. It is the individual winner’s responsibility to understand and abide by any federal, provincial, territorial, local, or foreign tax laws that may apply to receipt of the Prize. The winner must accept the Prize as awarded and may not transfer such Prize or substitute or exchange for, or apply the Prize’s value towards, cash or a higher cost or alternative prize. The Prize is non-refundable, cannot be replaced if lost or stolen and is provided on an “as is” basis, without any representation or warranty of any kind. The Sponsor reserves the right, in its sole and absolute discretion, to make substitutions of equivalent or greater kind or value in the event of the unavailability of all or part of the Prize or for any other reason whatsoever.

5.         WINNER SELECTION AND QUALIFICATION: Winners of the Prize(s) will be held on each week during the month of the active contest at the Sponsor’s office (the “Prize Draw”) for all eligible entries received by the Contest Closing Time. The Sponsor reserves the right to reschedule the Prize Draw at any time and for any reason without prior notice.

If an Eligible Participant is selected as the winner from the Prize Draw, the potential winner of the Prize will be notified via email at the email address provided upon entering the Contest. The potential winner may be required to complete and return a release form within a specified time period in order to redeem the Prize. The potential winner will thereafter be contacted by phone, during which they will be required to answer a timed, multi-step and multi-operational mathematical skill-testing question (the “Skill-Testing Question”) correctly, independently, without aid or assistance from any other person or device, in order to receive the Prize. If (i) the potential winner fails to answer the Skill-Testing Question correctly, (ii) the potential winner fails to return the properly executed release form within the specified time period, (iii) the Sponsor is unable to reach the potential winner at the email address or phone number provided, (iv) the potential winner fails to comply with any of the other Contest Rules, (v) the potential winner has cheated in any way, shape or form, or (vi) the potential winner may bring the Contest or the Sponsor or its affiliates into disrepute, then the potential winner will be disqualified from the Contest and be deemed to have forfeited the Prize. In such case, the Sponsor shall be entitled to select an alternate potential winner from the remaining eligible entries.

The Prize will be emailed to the winner(s) at the email address submitted by the winner(s) upon entering the Contest. If the emailed Prize is returned as undeliverable, the winner will be deemed to have forfeited the Prize.

If the selected Entrant does not respond to the email notification and claim the Prize within fifteen (15) days of the date the notification is sent, or if the email notification is returned as undeliverable after one (1) attempt, the selected Entrant will be deemed to have forfeited the Prize. In that case, the Sponsor may, in its sole and absolute discretion, disqualify the potential winner, thereby forfeiting any and all rights the potential winner may have to the Prize and the Sponsor shall be entitled to randomly select an alternate winner who will also be required to answer the Skill-Testing Question correctly and comply with all of the Contest Rules. Any disqualified winner will not receive any alternate prize, substitution, or compensation.

In the event an Entrant wins the Prize and is later found to be in violation of these Contest Rules, he/she will be required to forfeit the Prize or to reimburse the Sponsor for the stated value of the Prize if such violation is discovered after the winner has used the Prize. False, fraudulent or deceptive entries or acts shall render Entrants ineligible for the Prize.

No communications will be entered into with any Entrant other than with the potential winner.

6. RELEASE, INDEMNITY, AND LIMITATION OF LIABILITY: By entering into the Contest, each Entrant agrees to release, discharge, indemnify, and hold harmless the Sponsor and its subsidiaries and affiliates, and their respective advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors (collectively, the “Released Parties”) from and against any and all loss, injury, death, damage, liability, claims, deficiency, actions, proceedings, judgments, interest, award, penalty, fine, cost, or expense of any kind, including legal and professional fees (the “Losses”), arising out of or related to: (i) the Entrant’s participation in the Contest; (ii) the Entrant’s acceptance, possession, use, or misuse of the Prize or any portion thereof; (iii) any technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, servers, network, hardware, or software; (iv) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (v) unauthorized human intervention in any part of the entry process or the Contest itself; (vi) electronic or human error which may occur in the administration of the Contest, the processing of entries or the announcement of the winner, (vii) any breach by the Entrant of these Contest Rules; (viii) any representation or warranty made by the Entrant being untrue or inaccurate; and (ix) any violation by the Entrant of any law, regulation, or third-party right. This release and indemnity shall apply to the fullest extent permitted by applicable law. This release and indemnity applies regardless of whether the Released Parties have been advised of the possibility of such damages. These obligations will survive the conclusion of the Contest and/or the awarding of the Prize.

Except where prohibited by law, by participating in the Contest, each Entrant agrees that (i) any and all claims, judgments, and awards in favour of an Entrant shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, and in no event will any Entrant be entitled to receive lawyers’ fees or other legal costs; and (ii) under no circumstances will any Entrant be permitted to obtain awards for, and every Entrant hereby waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.

8.         GENERAL CONDITIONS:

(a)        All entries become the property of the Sponsor, and none will be returned.

(b)        The Sponsor is not responsible for typographical or other errors in the offer or administration of the Contest, including but not limited to, errors in advertising, these Contest Rules, or the announcement of the Prize winner.

(c)        No responsibility is assumed by the Sponsor for any inability of a person to successfully enter the Contest for any reason, including any problems or technical malfunction of any Internet or telephone network or broadcast transmission during the Contest. The Sponsor assumes no responsibility for falsified, late, lost, damaged, misdirected, garbled, or incomplete entries.

(d)       The Sponsor reserves the right to cancel, modify, suspend or terminate the Contest and/or these Contest Rules at any time without notice, for any reason, including, without limitation, if, in the opinion of the Sponsor, in its sole and absolute discretion: (i) fraud, misconduct or technical failures destroy or threaten the integrity of any portion of the Contest; (ii) a computer virus, bug, or other technical problem corrupts the administration, security, or proper conduct of the Contest; or (ii) there is any accident or printing, administrative or other error of any kind related to the Contest. In the event of an early termination of the Contest, the Sponsor reserves the right to determine the Prize winner in a random drawing from among all eligible, non-suspect entries received as of the time/date of such termination.

(e)        Entries generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified. Each Entrant must submit an entry and participate in the Contest on his/her own behalf. Any entry submitted on behalf of another individual, on behalf of a group or organization, or using another person’s email address, name or other personal information will be disqualified and ineligible to claim the Prize.

(f)        The Entrant agrees that it will not make any disparaging remarks about the Contest or the Released Parties. Notwithstanding any other provision of these Contest Rules, the Entrant may disclose truthful and accurate information, including facts or opinions regarding the Contest or the Released Parties, if and to the extent required by law, regulation, or legal process. However, to the extent legally permissible, the Entrant agrees to provide the Released Parties with prompt written notice of such legal requirement, sufficiently in advance of any disclosure, to allow the Released Parties a reasonable opportunity to seek a protective order or other appropriate remedy, or to waive compliance with this provision.

(g)        The Entrant agrees that it will not make any disparaging remarks about the Contest or the Released Parties. (h)        The parties have expressly required that these Contest Rules and all documents and notices relating hereto be drafted in English.

(i)         By entering the Contest, the Entrant agrees to receive e-mail newsletters periodically from the Sponsor. The Entrant can opt out of receiving this communication at any time by clicking the unsubscribe link in the newsletter.

(j)         TheSponsor respects your right to privacy. By entering the Contest, each Entrant consents to the Sponsor collecting, storing and using the personal information submitted with his or her entry in accordance with its privacy policy, only for the purpose of administering the Contest unless the Entrant otherwise agrees. (k)        By entering the Contest the entrant agrees to receive e-mail newsletters periodically from the Sponsor. The entrant can opt out of receiving this communication at any time by clicking the unsubscribe link in the newsletter.

(l)        The division of these Contest Rules into sections and the insertion of headings are for convenience of reference only and shall not affect the construction or interpretation of these Contest Rules. Unless otherwise specified herein, any reference in these Contest Rules to a Section refers to the specified Section of these Contest Rules. In these Contest Rules, the terms “these Contest Rules”, “hereof”, “herein”, “hereunder” and similar expressions refer to these Contest Rules and not to any particular part, Section or other provision hereof.

(m)        Unless the context requires otherwise, in these Contest Rules words importing the singular number only shall include the plural and vice versa and words importing the masculine gender shall include the feminine and neuter genders and vice versa.
